Another Civil Rights Violation. Another Title 42 § 1983 lawsuit

Larry Fuchtman is a criminal and crooked cop and should be fired

I had been at the Noble Science Library for a while. I probably got there at 4:00 p.m. after I left the rice bowl place on Rural by McDonalds.

I left and was walking West to go home. After I passed the Engineering Building probably was down by the Language and Liturature buildings I forgot I had to send another E-mail so I walked back to the Noble Science Library so I could send the final e-mail about a meeting we will have in a little less then 2 weeks.

On Tuesday I think June 10, 2003 at about 6:00 p.m. to 6:05 p.m. I was entering the Noble Science Library and Larry Fuchtman a cop on a bike asked me if I could talk to him. He was with another bike cop and perhaps a 3rd cop.

I should have said "No" but stupidly I said "Yes" and let myself be open to having my civil rights violated by crooked police again.

I don't remember his exact words but he said something to the effect that "I was walking around and avoiding the police", and he then asked me something like "was I walking around avoiding the police?" I don't remember if he said someone accused me of it, or if HE accused me of it.

I said something like "No".

Althought I probably should have asked him "If walking around avoiding the police was a crime?" knowing full well that "walking around avoiding the police is certainly NOT a crime". Or for that matter if "a private person taling a walk on the ASU campus which is public property is a crime?" which it isn't either.

He asked me if I had ever been stopped by the ASU cops.

I don't remember what I said but I think it was No.

He asked me if I went to ASU and I told him NO.

He then asked me if I would give him some ID.

I told him NO.

ASU police officer Larry Fuchtman seemed shocked like a deer that was looking into the headlights of an on coming car when I said that. I guess cops are not used to people demanding that they honor their 5th Amendment rights and refusing to answer their questions.

But ASU police officer Larry Fuchtman quickly turned back into a police bully. I don't remember his exact words but he told me if I wasn't going to give him any ID I would have to leave the ASU Campus and that if he ever saw me on the ASU Campus again I would be arrested.

This is when he started to violate my civil rights and violate U.S.C. 42 § 1983. He can't punish me or arrest me if I refuse to answer his questions. But he did punish me by telling me indirectly that I would be arrested if I didn't leave the ASU campus for refusing to provide him with ID, and that I would be arrested by him if I came on the ASU campus for refusing to provide him with ID.

I told him "OK. I will leave the ASU campus" or something to that effect. I should have told him he was a butthole and jackbooted criminal police thug for violating my civil rights but I did't want to piss him off and receive a beating or get faslely arrested.

And just so I would not have any problems finding out who to file a lawsuit against for violating my civil rights I asked him for his name and badge number.

He gave me a business card which I will scan and put here. He told me his badge number was 560.

By that time a few more cops had arrived and Larry Fuchtman said something badmouthing me because he had been kind enough to give me his ID but I refused to give him my ID. The jerk didn't mention he gave me his card AFTER I refused to give him my ID.

I left walking North taking the shortest path off the ASU Campus because I did not want to get arrested if I didn't leave quickly enought.

An ASU cop car then started following me. It would pass me and then stop. Then it would wait for me to walk past it and again drive past me again. It did this several times.

I didn't look at the ASU cop car because I didn't want to give them the opertunity to take pictures of my face.

I walked to University drive and then turned and went West on University Drive. An ASU Cop car continued to follow as I walked along University. I don't know if it was the same one that was following me on the campus.

When I got to Mill I went North and did not see the cop car following me again.

I then got on the Yellow Line Bus and took it to downtown Phoenix, where I hop on another couple of buses (I think the 27, RED, and finally BLUE lines to get me to the Phoenix Library where I wrote this up. Scan my bus card and put here for proof I did this.


Stuff to do:
This is the stuff I typed up at the first 15 minute computer session. Its pretty much a subset of this. It's also in timestamp1.html which is designed to give proof of the date and time I wrote the orginal page and date the time of my false arrest and being kicked off the ASU Campus. It was created on 06/10/03 10:55:22 PM EDT which is 7:55 p.m. Arizona Time. Looks like I got the date wrong. The timestamp says the date was June 10. In my notes I said the date was June 11.
